In the words of the prominent thinker and lawyer Frank Sanders, it is always important to “fit the forum to the fuss”. Within this wonderful phrase resides the basic premise and idea behind dispute system design.
With Mr. Glaholt’s help, parties will craft a process that resolves their complex disputes in an orderly, efficient, and systematic way, using all available tools and resources including: arbitration, mediation, early neutral evaluation, and co-med/arb.
Following meetings with the parties to gain a more thorough understanding of the dispute, Duncan's system design can take the form of a non-binding recommendation or a binding process, as the parties may choose
