The Ontario Construction Act contemplates party agreement to reference of construction lien actions to private individuals, who then report back to the court. This results in a consensual process, not unlike an arbitration but with the scope to include all parties and all issues that would otherwise be part of a lien action in a court proceeding.

 

In such situations Mr. Glaholt (literally) wrote the book on Conduct of Lien Actions, and has been appointed in this role on several occasions
